AUSTRALIAN TERMS AND CONDITIONS FOR ROBLOX GIFT CARDS AND CREDITS

Gift Cards are issued by Issuer. Issuer is responsible for the operation and maintenance of the Gift Card and the Gift Card programs. Issuer is the sole legal obligor to you; provided, however, that Issuer may assign its obligations with respect to the Cards at any time, in which case such assignee shall become the Issuer and sole legal obligor. Roblox Corporation (“Roblox”) and its affiliates and related entities (other than Issuer) bear no responsibility or liability for any Gift Cards, and to the extent permitted by law you hereby knowingly release Roblox and its affiliates and related entities (other than Issuer) from any and all liability or claims of any nature whatsoever arising in connection with any Gift Card, except to the extent that that liability or claim was caused or contributed to by the act or omission of Roblox, its affiliates and/or related entities.

Gift Cards can be purchased at authorized retailers and distributors or also at https://www.roblox.com/giftcards. Gift Cards are not valid and will not be honored if obtained from unauthorized sellers, resellers or distributors, including through Internet auction sites. Gift Cards are redeemable only for purchases of Credits at https://www.roblox.com. To redeem a Gift Card, you must be over 18 years old or obtain consent from a parent or guardian, have Internet access, login or register to create a Roblox account, and accept the then-current version of the Roblox Terms of Use or have your parent or guardian accept them if you are under 18 years old. The Terms of Use include User Terms, Creator Terms, the Privacy Policy and various other terms, which are subject to change from time to time, and are available at https://en.help.roblox.com/hc/en-us/articles/115004647846-Roblox-Terms-of-Use. Gift Cards are not debit or credit cards. Gift Cards have no cash value, are not refundable or reloadable and may not be redeemed for cash (except as required by law). Gift Cards cannot be resold. Gift Cards must be redeemed in full and cannot be partially redeemed. All amounts loaded onto a Gift Card are denominated in the currency of the country in which it was sold.

When you redeem a Gift Card, you will receive the equivalent amount of Credits in Australian Dollars in your Roblox account. For example, a AU$100 Gift Card will be redeemed for AU$100 in Credits. Gift Cards purchased outside Australia may also be redeemed for Credits to your account. When you redeem a Gift Card that is not denominated in Australian Dollars, the amount loaded onto the Gift Card is converted to Australian Dollars from the currency of the country in which the Gift Card was purchased and redeemed for Credits denominated in Australian Dollars. No fees or other charges are made to your Gift Card for the currency conversion. Currency conversions are based on exchange rates listed on XE.com and updated monthly to account for fluctuations in the values of international currencies. The Credits may be redeemed only for Robux (Roblox’s in-game currency issued by Roblox), a Premium Subscription to Roblox, subscriptions available within creators’ experiences on the Roblox platform (in available regions) and other Roblox services as designated by Roblox from time to time. A Roblox Premium Subscription is a monthly subscription program where you receive a specified number of Robux per month, as well as certain other benefits, in exchange for a monthly fee. To redeem Credits, you must be over 18 years old or obtain consent from a parent or guardian. Availability and pricing of Robux and Premium Subscriptions are subject to change (current pricing information can be found at https://www.roblox.com/upgrades/robux). Credits have no cash value, are not refundable or transferable and may not be redeemed for cash (except as required by law).

When you redeem a Gift Card, you may also receive a free virtual item plus a bonus code for an additional exclusive virtual item ("bonus item"); provided, however, that there is a limit of one free virtual item and one free bonus item per month per Roblox account unless otherwise determined by Issuer and its affiliates (for example, and without limitation, in connection with a promotion). The selection of which free virtual item and free bonus item you receive is entirely within the discretion of Issuer and its affiliates. Free virtual items and/or bonus items may be discontinued or replaced at any time by the Issuer.

Gift Cards do not expire. No fees for inactivity, maintenance or service fees apply. Issuer reserves the right to refuse to honor any Gift Card in the event of a disputed credit card charge, bounced check or other failure of consideration.

You must be 18 years or older to use, accept or redeem Gift Cards. If you are not 18 years or older, you must obtain the consent of your parent or guardian to redeem Gift Cards.

Lost, damaged, or stolen Gift Cards are not the responsibility of Issuer. The value of any lost, damaged or stolen Gift Cards, or any Gift Cards used without authorization, will not be replaced or replenished.

You have the sole responsibility to take all precaution to ensure that there is no unauthorized access of your Roblox account. Issuer is not responsible for the unauthorized access of your Roblox account and shall have no obligation to replenish the value of any unauthorized use of Credits.

For a period of at least 60 days prior to starting any arbitration or commencing legal proceedings in an Australian Court, User and Roblox agree to first engage in informal discussions to attempt to negotiate a resolution of any Dispute. These informal discussions must include live verbal conversations by telephone or other device if requested by any party. These informal discussions will start 10 days after written notice is sent from User to Roblox or from Roblox to User. These informal discussions must be concluded either by a resolution agreed to in writing by the parties or by written notice from one party sent 7-10 days prior to the expiration of the 60-day informal dispute resolution period specifically stating each unresolved demand and the basis therefore.

Roblox will send User notices to the email address or billing address that User provided to Roblox. User will send notices to Roblox Corporation, Legal Department, 970 Park Place, Suite 100, San Mateo, CA 94403 by certified U.S. Mail or by Federal Express (or international equivalent). In relation to any initial notice of a Dispute from a User, such notice must include: (a) the full legal name of the User making the claim, (b) the username of the User’s Roblox account, (c) the email address associated with the User’s Roblox account, if any, (d) a description of the nature and basis of the claim, (e) the specific result that is desired, and (f) the ticket or case number provided by Roblox Support to track previous attempts to resolve the Dispute, if there is one.

TO THE EXTENT PERMITTED BY LAW: (A) ISSUER AND ITS AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE; (B)IN THE EVENT THAT A CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REFUND, REPLACEMENT, OR REPAIR OF SUCH CARD. CERTAIN LEGISLATION, INCLUDING THE AUSTRALIAN COMPETITION AND CONSUMER ACT 2010 (CTH), MAY LIMIT THE ABILITY TO EXCLUDE LIABILITY OR MAY IMPLY WARRANTIES OR CONDITIONS OR IMPOSE OBLIGATIONS WHICH CANNOT BE EXCLUDED, RESTRICTED OR MODIFIED EXCEPT TO A LIMITED EXTENT. THESE TERMS MUST IN ALL CASES BE READ SUBJECT TO THESE STATUTORY PROVISIONS.

The laws of the State of New South Wales, Australia, without regard to principles of conflict of laws, shall govern this Agreement, use of Gift Cards and is the substantive law applicable to any claim or dispute that may arise out of or relate to this Agreement or your use of Cards.

Notwithstanding anything herein to the contrary, if any part of this Agreement is deemed invalid or inapplicable, such provision shall be modified or restricted to the extent and in the manner necessary to render it valid, legal, and enforceable. If such provision cannot be so modified or restricted, it shall be excised from this Agreement without affecting the validity, legality, or enforceability of the remainder of this Agreement, which shall be fully enforced.

Issuer reserves the right to change this Agreement from time to time in its discretion, acting reasonably, by posting the revised version of this Agreement at www.roblox.com/giftcardterms.

Issuer and its affiliates reserve the right to refuse to honor Gift Cards where Issuer suspects that the Gift Cards were obtained fraudulently.
