Creator Third Party App Terms

To participate in the Program, you must read, agree to, and comply with the Community Guidelines. Following are highlights for some, but not all, key terms.

1. Community Guidelines.
   1. Your App may not be used in any way to endanger the safety of any individual or entity, nor should it be used in any disrespectful, uncivil, or illegal way.
   2. You and your App must be transparent and fair at all times, and you may not, and your App may not be a means to, implement, participate in, or attempt scams, spam, cheating, or exploits.
   3. You may not misrepresent yourself or mislead others, including by impersonating others such as another developer, Roblox user or business entity. You and your App may not be misleading or suggest or imply any affiliation with Roblox or that Roblox endorses you or use of your App.
   4. You may not use or incorporate any intellectual property to which you don’t have rights to use.
   5. Your App must be secure, and you must take measures to ensure the security of Roblox accounts and systems. You may not attempt to gain unauthorized access to Roblox systems or accounts, or misuse or bypass Roblox systems.
   6. You and your App may not be used to hack any other account, phish, launch malicious software or code, or launch a cyberattack.
   7. You may not obtain and share sensitive personal information of others.

To enable Roblox to make your App available to end users, you must and hereby do grant Roblox a perpetual, irrevocable, transferable, sublicensable, worldwide, non-exclusive, royalty-free right and license to host, store, import, localize, display, perform, distribute, and use your App and related content including, without limitation, all logo, trademarks, service marks or trade names related to your App.

You must be the owner of or fully authorized to grant rights in all parts of your App and related content. You agree to pay all amounts owed to any person as a result of you uploading or making your App and related content available through the Services.

You are responsible for your App and represent and warrant that: (a) you are the creator and owner of, or have the necessary rights and permissions to use and to authorize Roblox to use, the license that you grant to Roblox in this Policy; (b) your App and the use of your App does not and will not: (i) infringe, violate, or misappropriate any third-party right; (ii) slander, defame, libel, or invade the right of privacy, publicity or other property rights of any other person; (iii) require Roblox to get licenses, permissions, or consents from, or pay compensation or provide attribution to, any third parties; (iv) result in a breach of contract between you and a third party; or (v) cause Roblox to violate any law, statute, rule or regulation; (c) your App and any related materials will not contain (x) viruses, malware, or any other malicious or harmful content, (y) any matter that is injurious to end users or their property, or (z) any content which is otherwise unlawful or tortious, (d) you will comply with all laws, rules, statutes, regulations, contractual obligations and self-regulatory obligations applicable to any collection, use, disclosure, onward transfer, and other processing of personal information of Roblox, its platform users or any other third party, and (e) you will comply with all applicable laws, statutes, rules and regulations and this Policy.

You shall and hereby agree to defend, hold harmless and indemnify Roblox and Roblox’s officers, directors, employees, consultants, affiliates, investors, business partners, subsidiaries, and agents from and against every claim, liability, damage, loss, and expense, including reasonable attorneys’ fees and costs, arising out of or in any way connected with: (a) your access to, use of, or alleged use of the Services; (b) your violation of any part of this Policy, including, any representation, warranty, or agreement referenced herein, or any applicable law, rule, statute or regulation; (c) your violation of any third-party right, including any intellectual property right, publicity or privacy right, property right, or confidentiality obligation; (d) any dispute or issue between you and any third party; and (e) your App, including the use of your App by Roblox or any third party.

You must and hereby agree to comply with your own privacy policy which must be in accordance and ensure your compliance with any relevant data protection or privacy legislation. You will not provide personally identifiable data to Roblox except as expressly agreed with Roblox in writing.

If you or your App collects any personal data from users or other third parties in connection with the use of your App, you will provide a clear and conspicuous privacy notice to such third parties that accurately describes how you collect, use, and protect that information. You must collect all necessary consents and permissions for such collection and use and comply with all applicable laws, rules, regulations and policies. You must not collect or use third-party data for any reasons that are not expressly set forth in your privacy notice.

Your collection and use of data, usage information and metrics shall only be as permitted by users of your App. You may not collect or aggregate any such data, information or metrics through your App or otherwise use your App or the Services to assess the performance or to gain insights into Roblox's usage, revenue, or any other aspects of Roblox's business or operations.

You acknowledge and agree that Roblox shall not be and is not responsible or liable in any way related to or arising from your App. You agree to and hereby assume all risk for any damage that may result from your App, your use of or access to the Services, your dealings with any users or creators on the Services, and any materials or content available through or on the Services.

Your App must include terms of use (“App Terms”) which (a) require any user or other third party accessing your App to agree to and comply with the Roblox Terms, and (b) expressly state that (i) the App Terms are between such third party and you only, and not with Roblox, (ii) Roblox is not affiliated in any way with you or your App, (iii) Roblox is not responsible or liable for any party’s use or accessing of your App, (iv) Roblox has no obligation to provide any maintenance and support service with respect to the App, and (v) by using or accessing the App, such third party acknowledges and agrees that it waives and releases any and all claims, liabilities, damages, losses, and expenses against Roblox arising from or related to the App.

Your App must accurately obtain and disclose all permissions and consents required from users to use the App.

You may not create, and your App may not contain, any malicious, harmful or abusive content or any content that violates any Roblox policy or guideline, or circumvents, or attempts to circumvent, any measures meant to protect the Services.

You must not disable, override or otherwise alter any system-level features or other system behavior of Roblox. Your App must not contain any features, functionalities or other elements that could confuse users regarding the distinction between your App and Roblox’s system or the Services.

Notwithstanding anything to the contrary in the Roblox Terms or otherwise, neither you, nor your app, may use Roblox’s name, trade name, marks, or logo without the prior written consent of Roblox.

You must make best efforts for your app to follow and meet CASA requirements, based on OWASP's Application Security Verification Standard (ASVS).

Roblox is not liable for, nor is Roblox obligated to screen, approve, edit or control your App and any related materials. Roblox may, however, at any time and without notice, and without any obligation to you, remove, block, or suspend the availability of your App, if Roblox believes violates this Policy or the Roblox Terms or is otherwise objectionable or damaging to Roblox. You agree to waive, and do waive, any legal or equitable right or remedy that you have or may have against Roblox regarding your app. If notified by a user or content owner that your App allegedly violates the Roblox Terms, Roblox may investigate and decide whether to remove the App (which Roblox can do at any time, without notice).

If a third-party reports that your App violates Roblox policies or the Roblox Terms, or if Roblox determines in its own discretion that you or your App violates Roblox policies or the Roblox Terms, Roblox may terminate your App from the Program. Roblox reserves the right to suspend, disable and/or take down any App that violates our applicable terms and to take other appropriate action in accordance with the rights and remedies available to Roblox.
